What happens to your things when you go?

A will lets you decide. Without one, Singapore law decides for you — and not always the way you’d want.

A will is a legal document that sets out how your estate — everything you own — should be distributed after you pass away. It also lets you appoint an executor to manage your affairs and a guardian for any children under 21.

Without a will, your estate is distributed by default under the Intestate Succession Act ². The default rules may not match what you actually want. For example, if you’re married with children, the law splits your estate 50% to your spouse and 50% to your children — even if you wanted to provide for parents or siblings too .

For Muslims domiciled in Singapore, the rules are different. Distribution is governed by the Administration of Muslim Law Act (AMLA) and Faraid principles. A Muslim will (Wasiat) can only freely allocate up to one-third of the estate to non-Faraid beneficiaries ⁵ ⁶.

Some assets sit outside your will entirely. CPF savings, for example, are not covered by a will — they pass via a separate CPF nomination made through CPF Board . HDB flats and property held in joint tenancy pass to the surviving co-owner by right of survivorship and cannot be distributed via will .

CRITICAL THINGS TO KNOW

Three rules people get wrong.

Witnesses cannot be beneficiaries. A gift in your will to anyone who witnessed the signing (or their spouse) is void ³.

Marriage revokes a previous will. Unless your will was made “in contemplation of marriage,” getting married cancels it ³.

CPF is separate. CPF monies do not form part of your estate. You need a separate CPF nomination .

Different lives, different wills.

A single 28-year-old renting an HDB flat needs a different will from a married couple with three children — and both need something different from a Muslim family bound by Faraid. Pick the one that fits.
